The customers (users) of Human Tales Technology Private Limited ā€“ known by the brand name ā€œTHINGSā€, using this site by implication, means that users have gone through and agreed and abide by the following, disclaimer, Terms & Conditions.

No Warranty

It is imperative to note that THINGS has made required efforts to ensure that the information provided on THINGSā€™s App/Website is reasonably accurate, however, THINGS does not warrant its accuracy, completeness or suitability, correctness, adequacy validity, whatsoever for any purpose. As such database provided is without any warranty, express or implied, as to their legal effect.

No Liability

  • Though THINGS has taken proper care/precaution to make the database reliable, THINGS will not be held responsible for any liability that may arise out of any such error in the database. Further, THINGS does not represent that THINGSā€™s App/Website is free of viruses or harmful components.
  • Use of any information on THINGSā€™s App/Website shall be at your own risk.
  • All information should be used by applicable laws. And THINGS does not undertake any kind of liability whatsoever for the same.
  • In case of transaction/statement is not in agreement with your record or with the information that you have, you are requested to write to THINGS. You are free to mail your queries to contact@thesnug.app
  • THINGS has provided information/database on the App/WebSite on an ā€œas is where is ā€ basis. THINGS expressly disclaims to the maximum limit permissible by law, all warranties, express or implied, including, but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • THINGS disclaims all responsibility for any loss, injury, liability, or damage of any kind resulting from and arising out of, your use of the site.

Miscellaneous

  • It will be the sole responsibility of the User to ensure that the use of phone number, and OTP are kept confidential and not disclosed to any third party, including any representative of the THINGS, or its agents, and shall take all possible care to prevent discovery of the user name or password by any person.
  • THINGS makes no representations about the timeliness, of the services contained on the THINGS App/Website for any purpose.
  • THINGS makes no representations about the suitability, reliability, or availability, of the services contained on the THINGS App/Website for any purpose.
  • THINGS shall not be responsible if any information/ database/ statement/ page is printed/ downloaded from THINGSā€™s app/site and after printing/ downloading complete/partial, text/information is altered/ removed/ obscured contained therein.
  • THINGS, at no event, be liable/ responsible for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data, or profits, arising out of or in any way connected with the use of the THINGS App/Website.
  • THINGS, at no event, be liable/ responsible for any direct, indirect, punitive, incidental, special, consequential damages or any damages for the delay or inability to use the THINGS app/website, or failure to provide services, or for any information, date, statement, software, and any other services obtained through the THINGS app/websites, or otherwise arising out of the use of THINGS App/Website.
  • Certain services, such as accounting information depend on continuous connection to the THINGSā€™s database. THINGS makes no assurance, representation, or promise whatsoever that such connectivity will always be available.
  • THINGS reserves the right to suspend these services if in THINGSā€™s opinion security of the site or of the data could be compromised.
  • THINGS may also suspend services on the App/Website for any customer at its sole discretion without assigning any reason whatsoever. In such event, user shall contact THINGS offices for any clarification.
  • THINGS reserves the right to levy any service charges as applicable from time to time in consideration of the services provided herein to all the users. In case the user is not consenting to any service charges then, the user may opt out of THINGS services.

Terms & Conditions while signup

  1. These Additional Terms shall be applicable for all sellers and users made available by Human Tales Technology Private Limited  (ā€œTHINGSā€).
  2. I confirm that I have carefully read and fully understood all the terms and conditions that are listed online at https://www.thingsapp.co/terms-2/ and privacy requirements that are listed online at & https://www.thingsapp.co/privacy/ . 
  3. I understand that approval of the seller’s product-selling video is at the sole discretion of THINGS. The team at THINGS may accept or deny my video with information provided by THINGS and based on their internal discretion criteria. THINGS plays no role in recommending any particular seller video, whatsoever.
  4. I understand that the minimum age criteria to be a seller/user is 18 years.
  5. I confirm that when I submit a video for selling products, I will be responsible enough for doing so only for products that can be legally sold in India, and by the law of the land
  6. I shall indemnify THINGS (its agents, employees, officers, and directors) against all or any losses suffered by THINGS (its agents, employees, officers and directors) on account of representations and warranties by me including any legal action/proceedings initiated by me or any third party in connection with this Agreement and unauthorized access to or storage of my information or Personal Data by THINGS (its agents, employees, officers and directors) which are solely attributable to any breach, negligence or fraud by me.
  7. I hereby agree to provide all information as may be required by THINGS to process my selling requirements. 
  8. I declare that all the particulars and information and details given/filled in the application form provided by THINGS and information provided by me to THINGS are true, correct, and accurate and I have not withheld/suppressed any material and relevant information from THINGS.
  9. THINGS makes no representations about:
    1. the timeliness, of the services contained on the THINGS its App/Website for any purpose; and
    2. the suitability, reliability, and availability, of the services contained on the THINGS App/Website for any purpose.
  10. THINGS shall (and shall procure that its agents, employees, directors, and officers shall) comply with all Data Protection Legislations and such compliance shall include, but not be limited to, maintaining a valid and up-to-date registration or notification (where applicable) under the Data Protection Legislation. For this Agreement, ā€œData Protection Legislationā€ means the legislation and regulations relating to the protection of Personal Data and processing, storage, usage, collection, and/or application of Personal Data or privacy of an individual including (without limitation):
    1. the Information Technology Act, 2000 (as amended from time to time), including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (ā€œPrivacy Rulesā€) and any other applicable rules framed thereunder;
    2. any other Applicable Law solely relating to the protection of Personal Data and processing, storage, usage, collection, and/or application of Personal Data or privacy of an individual.
  11. By joining as a seller/user under these Additional Terms, you acknowledge that THINGS may use my data or information in connection with the product, including without limitation for the processing of the sale. In this regard, the customer agrees and consent for THINGS to share the information or data pertaining to me with any third party which is involved in the processing of the sale etc.
  12. THINGS reserves the right to cancel / suspend the services if in THINGSā€™s opinion security of the App/Website or of the data could be compromised for any specific customer, without assigning any reasons.
  13. I/We further authorize THINGS and all its group companies to keep me/us informed (vide telephone, SMS, mail, E-mail, Whatsapp etc.) of all such promotional schemes and/or activities as they may require.
